· Title Two. Objectives of the Foundation and basic rules for determining the beneficiaries and using resources to fulfill the foundational objectives

Article  6. Objectives
The general objectives of the Foundation are to promote solidarity and cooperation among countries and people in order to achieve human development.  Consequently, it helps, supports, and respects the processes of groups, popular organizations, and communities fighting for a fairer, more decent world for everybody.  The Foundation will be able to carry out any kind of actions, activities, and services to achieve that objective.
 
Article  7. Foundational activities
To achieve its objectives, the Foundation can carry out the following activities and it will work on them independently, together with the founder Association or in coordination with other institutions with similar ends.  They are:
a) to collaborate in projects of Development Cooperation and Humanitarian Aid;
b) to support activities for the promotion and defense of Human Rights;
c) to make people aware of the tremendous differences between the North and the South; and
d) to promote equal opportunities and gender equality.
The former statement does not involve any limitations.
In order to fulfill these objectives, the Foundation reserves the right to carry out all the activities deemed necessary, including commercial activities and import-export activities, always according to the terms authorized by the Law.
 
Article  8. Freedom of performance and Collaborators
The Board of Governors will have absolute freedom to determine the activities of the Foundation aimed at achieving the specific objectives it considers most adequate or convenient at any time.
In order to carry out the various activities, it shall have the help and collaboration of natural or legal persons that work with the Foundation through personal service, financial contributions, or both; on a temporary or periodic basis, or permanently or indefinitely; natural or legal persons who receive the following namings for such purpose and who may be recognized as such by the Board of Governors in each case.
  • Collaborators are those who contribute financially, with their personal effort, or in both ways on a regular basis.
  • Donors are those who give a one-time financial contribution that is not necessarily linked to a certain project.
  • Sponsors are those that contribute financially, with their personal effort, or in both ways to a specific activity, program, or initiative.
  • Benefactors are those that contribute financially, with their personal effort, or in both ways and are thus named benefactors due to the important amounts of money they contribute.
Article  9. Determining the beneficiaries
Following criteria of impartiality and non-discrimination, the Board will select the beneficiaries among the persons that meet the following requirements:
a) To be part of the population sector aided by the Foundation.
b) To demand the assistance or service that the Foundation can offer.
c) To lack the necessary means to obtain the services rendered by the Foundation.
d) To fulfill the specific requirements that the Board of Governors could grant in addition for each call.
The following qualify as beneficiaries of the Foundation:
• Any person or group of persons object and subject of the campaigns aimed at promoting international solidarity and cooperation against poverty, for human development, and for Human Rights.
• The groups, mainly from the Third World, who are objects of the aids.
• The Non-governmental Organizations (NGOs) or entities from developing countries (Counterparts or Partners) which promote or carry out activities and projects to improve material, sanitary, social, cultural, human development and Human Rights conditions, in order to achieve a balanced and complete development of the people.
 
Article  10. Use of income
1. At least seventy percent of the profits of the economic activities that are carried out and of the income that is obtained by any other means, deducting the expenses incurred in order to get this income, must be used in carrying out the foundational objectives in the terms stipulated by current legislation.  The rest must be destined to increasing the Foundation’s endowment or reserves according to the agreement of the Board of Governors.
2. The Foundation can make this obligation effective in the period of time starting from the beginning of the financial year in which the income was earned and ending four years after the end of the aforementioned financial year.
